I. General Provisions
The Privacy Policy defines how personal data necessary for the provision of electronic services through the www.exceldent.pl website (hereinafter: the Service) are collected, processed, and stored.
The Service collects only personal data necessary for the provision and development of services offered therein.
Personal data collected through the Service are processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter GDPR) and the Polish Act on Personal Data Protection of 10 May 2018.
II. Data Controller
The data controller for personal data collected through the Service is Excelmed Spółka Cywilna Monika Rączkowiak Bartosz Rączkowiak, NIP 8513121173, REGON 320855024, email address: admin@exceldent.pl (hereinafter: the Controller).
III. Purpose of Data Collection
Personal data are used for the purpose of:
- registering an account and verifying the User’s identity,
- enabling logging into the Service,
- performing a contract for services and e-services,
- communicating with the User (live chat, contact form, etc.),
- sending newsletters (after obtaining the User’s consent),
- operating a commenting system,
- providing social media services,
- promoting the Administrator’s offer,
- marketing, remarketing, affiliation,
- personalizing the Service for Users,
- conducting analytical and statistical activities,
- debt collection,
- establishing and pursuing claims or defending against them. Providing data is voluntary but necessary to conclude a contract or use other functionalities of the Service.
IV. Types of Processed Personal Data
The Administrator may process the User’s personal data: name, date of birth, address, email address, telephone number, NIP (Tax Identification Number).
V. Period of Personal Data Processing
User’s personal data will be processed for the period:
- when the processing is based on the performance of a contract – until the expiration of claims after its performance,
- when the processing is based on consent – until its withdrawal, and after the withdrawal of consent until the expiration of claims. User’s personal data will not be transferred outside the European Economic Area (EEA).
VI. Sharing of Personal Data
User’s personal data will be processed for the period:
- when the processing is based on the performance of a contract – until the expiration of claims after its performance,
- when the processing is based on consent – until its withdrawal, and after the withdrawal of consent until the expiration of claims. In both cases, the limitation period is 6 years, and for claims for periodic services and claims related to business activities – 3 years (unless a special provision provides otherwise).
VII. User Rights
The User of the Service has the right to: access their personal data, rectify them, delete them, restrict processing, transfer them, object to processing, withdraw consent at any time (without affecting the lawfulness of processing based on consent before its withdrawal). A request related to the exercise of rights under the aforementioned rights should be sent to admin@exceldent.pl. The Administrator will fulfill or refuse to fulfill the request immediately, but no later than within one month from its receipt. The User has the right to lodge a complaint with the President of the Office for Personal Data Protection if they believe that the processing violates their rights and freedoms (GDPR).
VIII. Cookies
The Service collects information using cookies – session, persistent, and third-party cookies. Collecting cookies supports the correct provision of services in the Service and serves statistical purposes. The User can specify the scope of access to cookies on their device in the browser settings. Cookies are used for:
- customizing the content of the Service’s web pages to the User’s preferences and optimizing the use of web pages; in particular, these files allow recognizing the User’s device and displaying a web page tailored to their individual needs,
- creating statistics to understand how Users of the Service use web pages, which enables improving their structure and content,
- maintaining the User’s session in the Service (after logging in), thanks to which the User does not have to re-enter their login and password on each subpage of the Service. The following types of cookies are used within the Service:
- “necessary” cookies, enabling the use of services available within the Service, e.g., authentication cookies used for services requiring authentication within the Service,
- cookies used to ensure security, e.g., used to detect fraud in the field of authentication within the Service
- “performance” cookies, enabling the collection of information on how Users use the Service’s web pages,
- “functional” cookies, allowing the “remembering” of selected settings and personalization of the User interface, e.g., in terms of the selected language or region from which the User comes, font size, appearance of the web page, etc.,
- “advertising” cookies, enabling the delivery of advertising content more tailored to the User’s interests.
IX. Automated Decision-Making and Profiling
User’s data may not be processed in an automated manner that could lead to any decisions affecting them. User’s data may be profiled for the purpose of adjusting content and customizing the offer after obtaining their consent.
X. Final Provisions
The Administrator has the right to make changes to the Privacy Policy, with the User’s rights not being limited. Information about the introduced changes will be communicated in the form of a message available on the Service. Matters not regulated in this Privacy Policy are governed by the provisions of the GDPR and Polish law.
